In this article there is an analysis of the argumentative content of constitutional rulings involving the nonapplicationof the health system rules, in order to prioritize the protection of the fundamental right tohealth. The result in the work of tracing the statements was characterized by the absence of a hermeneuticconstruct by the judge at the time of its decision, taking into account that the same law allows the officerto perform a legal interpretation and construction in its judgments through diffuse constitutional control. |
