Sumario: Regardless of the theoretical and conceptual difficulties, regulation has become an important issue forthe analysis of the state and law transformations.In this article we try to do a conceptual and historical approximation to the phenomenon of regulation, tothe institutional design that is being adopted by the state for its exercise and to the need to adopt somesort of methodology to determine the institutional capacity for fulfilling this function.
