The recognition and implementation of reparation measures is a cardinal aspect in societies undergoing a transitional process such as Colombia. This article seeks to analyze the basis of the obligation of granting reparations to victims of human rights violations from diverse theories of justice. For this, it proposes a teleological vision as the most adequate to achieve the ultimate aspirations of a society that seeks to overcome an armed conflict and to achieve a sustainable and lasting peace. This approach emphasizes on the role of reparations as part of the main goals of transitional justice, articulating individual and collective rights, as well as adequate conditions for advancing victims´ and societies´ life projects, through the vindication of the notion of common good. Thus, the article presents a multidimensional logic that involves the three dimensions of reparations: individual, collective and transcendental. Following this concept, it formulates some practical legal-political effects which would result from the application of this multidimensional theological vision. |
