Sumario: The development of the risk equation in civil liability insurance policies is themain issue studied throughout this text along with the rules, jurisprudence anddoctrine to the extent that its discussion entails a number of elements that areimportant to insurance companies. Hence, the issue researched along with risklimitation clauses, the occurrence of the loss, verification thereof, events resultingin a loss and the definition within the contractual language are topics thatshow a difficult panorama when trying to define which is the coverage to beprovided. Are we before risk limiting clauses in a temporal ambit or rather beforeharmful rights-limiting clauses? And it’s precisely this issue another veryimportant moot point because non-defined coverage aspects pose the biggestdilemmas for insurance companies at the time of covering losses that do notoccur frequently and with respect to which a solution has not yet been devised.
