Sumario: Colombia is a country with over half a century of armed conflict, a country facing since 2012, peace talks between the government of Juan Manuel Santos and the Revolutionary Armed Forces of Colombia, negotiations seeking outlets that allow completion the armed conflict through constitutional reform introduced by the legislative act 01 2012 "legal Framework for Peace", this article presents a dilemma that arises when applying the model of transitional justice and regulatory framework governing the current negotiation process with armed groups in Colombia and participation in politics by establishing different requirements for introducing constitutional validity and feasibility within the Colombian legal framework.
