In Colombia there are two rules governing the same case, that is contemplating legal consequences in the event of unjustified dismissal, on the one hand the Protocol of San Salvador (literal article d) indicating as guarantees payment of compensation or reinstatement Jan will employment, and on the other the Substantive Labour Code Article 64, which only provides for the possibility of financial compensation; in that order of ideas, to rise to the question what should be applied ?; should be made to the constitutional principles of labor law (internal), who can respond, among these, to be applied in the judicial field, this is the principle of lenity, it means that when there are two rules should be chosen by one that is more favorable to the employee, while the prevalence side that may have international treaties on human rights in the domestic order. |
