Sumario: The article develops from the theoretical reflection on the concept of enemy as the subject of penal regulation. Based on some relevant theories, it is intended to discuss the extent to which the use of the category of enemy contributes to discriminate the penal subject between deserver and non deserver of procedural and substantive safeguards, considering interests that are different to those of a criminal policy that is structured on the conception of human dignity. Some norms and the implementation of the category of enemy in Colombian law are analyzed, when infringing essential constitutional principles.
