The purpose of this article is to identify those issues derived from non-fulfillment by one of the parts in the belly lease contract in Colombia. Initially, characteristics and backgrounds will be shown as a contractual figure in the Colombian law as well as its implications when breaching. The importance of this study resides in the fact there is a lack of regulation, so the need of analyzing existing regulations, doctrine and jurisprudence, also the presence and applicability of the law on surrogate motherhood adjusted to the needs of the population and the social context which goes by the light and technological advances will be scoped |
