Sumario: Directive 2004/35 is an ambitious attempt to protect the environment in the European Union by means of a liability regime with a wide scope of application, of a mainly strict nature and with relevant obligations for the operators; however, it also poses certain complex questions, such as the identification of the environmental damage that must be repaired or the way in which such damage should be repaired. Maybe these complexities have caused the apparent lack of general application of this rule in the European Union Member States. The experience of this rule in Europe should be useful for other regions or countries when preparing laws that, in line with a better protection of the environment, achieve a more effective application.
