The work analyzes the connections between the duty to motivation of the judgments with the evidentiary initia-tive of judge. Adhering to the epistemological conception of the proof and motivation as a rational justification of the decision, the author shows the need for the resolution that orders evidence ex officio, it must be rationally justified, proposing the pertinent criteria. |
