Counter-rights, object in the legal procedure and dismissal in Brazilian Civil Procedural Code of 2015
This essay examines the nature of the legal decision that adjudicates a “counter- ight” (substantial excep-tion) exercised by the defendant, concluding that both when the counter-right is accepted or denied, the decision is on the merits and produces res judicata.
