Sumario: This article talks about the need for the Peruvian State to perfect its environmental liability regime to comply more efficiently with the mandate of environmental protection. To do this, the authors propose to establish a more comprehensive environmental liability regime that distinguishes between liability for causing harm and liability for causing a risk, to secure a system of environmental restoration and repair, without leaving aside the issue of prevention and the commitment of the company to take environmental cost.
