The action guardianship is a very important legal, political and social conquest for Colombia that was incorporated in the 1991 Political Constitution, and since then this action has served to achieve the realization of the fundamental rights of Colombians. Due to its noble and remarkable results, with time had more reception, situation by that the national government had to regulate the knowledge of these demands of action guardianship within the jurisdiction with the issuance of Decree 1382 of 12 July 2000. The application of the aforementioned regulation has not been peaceful by the high Colombian courts, thereby causing the denature of the characteristics of such an important mechanism. |
