Sumario: This article expose some reflections about the essential elements of the expression of consent of the States to be bound by international treaties: the instrument – object of the consent, the represent of the State and the way to express its will. The author realize a short retrospective study of the expression of consent of the State, since the XVIIth century to the present. The purpose is to analyze the principles, the derived conditions and characteristics established in the Law of Treaties, has been governing this legal institution in each historical context of the International Society. Also is demonstrated a necessity of more real and complete comprehension about the theorical and practical problems of the juridical act of consent, as a fundamental phase of the treaty-making procedure.
