The theory called "Basic Rights Drittwirkung" is one of the most relevant on the issue of the
protection of Human Rights (hereinafter HR); Therefore, in the present investigation seeks
from the same set as the State can´t be held solely responsible for the violations of human
rights, such as raised United Nations, as in the Colombian context a clear example is presented
as a particularly in this case, Multinational enterprises (Multinational) may be violators of
human rights. Therefore, the origin of the Drittwirkung and its scope in the area of law shown,
along with a comparison to roughly with other legislation such as the American, where there is
another influential mechanism on the subject, called: ALIEN TOR CLAIMS ACT OF 1789
