Sumario: Marriage between same sex couples is not an option in Ecuador, this does not allow the country's Constitution to offer the same rights for all citizens, positioning the members of the LGBTI community as persons of second class. The purpose of this investigation is to bring visibility to the dichotomies that the Constitution currently suffers from when it comes to providing equal rights for all. However, this document does mention equal rights and no discrimination as well as the International Treaties for Human Rights, which should always be abided by. Nevertheless, the members of the LGBTI community have been constant victims of discrimination due to their sexual preferences, this said discrimination was allowed because there were no laws to protect this community. In the year 2008, the Constitution gave a very big step in the subject of rights. This meant no discrimination due to sexual preferences, and the de facto union between same sex couples to recognize heritable assets for homosexuals. Unfortunately this advancement is only written in paper because in order for the poll to be accepted there have been many conditions.
