Sumario: In Peru a broad or polysemic concept of privatization is managed, which involves all types of activity that seeks to return or transfer ownership or management of assets, companies, goods and services from the State to private individuals.The legal framework for the Promotion of Private Investment has avoided regulating or legally introducing any type of powers, powers or state prerogatives that may have a direct impact on the execution of the concession contract, which may represent high risks for the attraction of Private investment as a result of the indiscriminate public intervention in the economy of the country occurred in the decade of the seventies and eighties. From 1991 to date, the State has been concerned with constantly reformulating the legal regime for the collection and promotion of Private Investment through adjective guidelines on public services, public infrastructure works and state resources, without concern for the Special regime of the concession contract.
