In this paper the author answers the question about the viability of regulation and protection of some elements on the web that have significant impact on our daily lives, such as advertising images, called “nicknames”, “templates “, “memes”, “hashtags”, “banners “, etc. Thus, first, a legal definition of the different web elements is discussed. Then, the author analyses the protection of domain names as a trademark and purposes some solutions to the conflict between domain names and trademarks through INDECOPI (Competence Agency in Peru). In third place, the author analyzes the relevance of the protection of hashtags, keywords and metatags as distinctive signs. In fourth place, the author studies the nicknames and its difference with pseudonyms in the trademarks registration. In fifth place, the author analyzes the well-known memes and if its nature lends itself to the legal protection or remains it free regarding Intellectual Property. In sixth place, the author refers to the protection of the personalized web designs and the templates through the Copyrights and the repression of unfair competition. Finally, the article presents a framework to analyze the banners, links and frames protected by the repression of unfair competition. |
