The main purpose of this article is to develop the constitutional content of the right of property of the indigenous people over territories where they have lived historically, that regarding the problem of the Government compromise on granting property titles. In order to achieve this, first, it follows the national and international jurisprudence that develop this topic. Later on, this article makes an approximation to the content of this right of property in our constitutional context. Also, it suggests the protection the Government should provide to grant this right and the measures that have to be taken. Finally, it develops possible answers to the principal questions this topic brings on. |
